By using Foxnett’s services, you agree to comply with these Terms of Service, our Privacy Policy, and any additional policies posted on our website. If you do not agree to all the terms and conditions of this agreement, you may not access the website or use any services.
2. Services Provided
Foxnett provides premium infrastructure and web services including, but not limited to:
- Cloud Hosting & WordPress Hosting
- Virtual Private Servers (VPS)
- Domain Registration & Management
- Google Workspace & Zoho Services
- Windows Hosting
- Bulk SMS Services
We reserve the right to modify, discontinue, or add new services at any time without prior notice.
3. Account Registration & Responsibility
- You must provide accurate, current, and complete information when creating an account.
- You are solely responsible for maintaining the confidentiality of your login credentials and API keys (e.g., API tokens, access keys, etc.).
- Any activity occurring under your account will be considered your responsibility.
- If you suspect unauthorized use of your account or a security breach, you must notify Foxnett support immediately.
4. Payment, Billing, and Renewals
- All services are billed in advance, based on your selected billing cycle (e.g., monthly, annually).
- Payments are processed securely through authorized third-party providers. Foxnett does not directly store complete credit card numbers on our servers.
- Failure to make timely payments may result in the suspension or termination of your services.
- Prices for our services are subject to change. Existing customers will receive a minimum of 30 days' advance notice of any pricing changes affecting their active subscriptions.
5. Acceptable Use Policy (AUP)
You agree not to use Foxnett infrastructure or services for malicious, illegal, or highly disruptive activities, including but not limited to:
- Hosting or distributing malware, viruses, phishing kits, or participating in fraudulent operations.
- Spamming, operating bulk email networks, or sending unsolicited commercial messages.
- Storing or transmitting illegal content (including pirated software, unauthorized copyrighted material, or abusive media).
- Engaging in activities that degrade, harm, or disrupt Foxnett’s network performance or the experience of other tenants (e.g., DDoS attacks, cryptomining on standard hosting plans).
Enforcement: Violation of this policy will result in immediate suspension or permanent termination of your services without the possibility of a refund.
6. Domain Registration
- Domain registrations, transfers, and renewals are subject to the rules and policies of ICANN and the respective Top-Level Domain (TLD) registry.
- Failure to renew a domain name before its expiration date may result in service disruption, additional redemption fees, or the permanent loss of the domain.
- You are legally required to ensure your administrative and technical contact details are accurate and up to date in the WHOIS database.
7. Service Availability & Uptime
Foxnett strives to provide enterprise-grade reliability and high availability for all services.
- While we utilize redundant systems, we provide our services on a commercially reasonable "best-effort" basis. We currently do not offer a financially backed Service Level Agreement (SLA) guaranteeing specific uptime percentages.
- Scheduled maintenance windows, network routing issues beyond our edge, or force majeure events may cause temporary downtime.
- Foxnett is not financially liable for lost revenue, data, or business disruptions caused by standard service interruptions.
8. Data Security & Backups
We implement industry-standard security measures including firewalls, DDoS mitigation, and encryption protocols to protect our network infrastructure.
Customer Responsibility: Customers are strictly responsible for maintaining their own off-site backups. While Foxnett may provide courtesy automated backup services on certain plans, we do not guarantee the full integrity or availability of these backups for restoration in all edge cases.
9. Termination & Suspension
We reserve the right to suspend or terminate your access to our services at our sole discretion if:
- You violate these Terms of Service or our Acceptable Use Policy.
- Your account falls into severe arrears.
- Your usage patterns cause critical harm to our infrastructure, IP reputation, or other customers.
You may terminate your account and cancel services at any time through your client portal. Please refer to our Refund Policy for details on eligible pro-rated refunds.
10. Limitation of Liability
- Foxnett provides all services on an “as is” and “as available” basis without warranties of any kind, either express or implied.
- Under no circumstances shall Foxnett be held liable for indirect, incidental, special, or consequential damages (including, but not limited to, loss of revenue, data loss, or business interruptions).
- Our total cumulative liability to you for any claims arising from our services shall not exceed the total amount you paid to Foxnett in the three (3) months preceding the incident.
11. Indemnification
You agree to indemnify, defend, and hold harmless Foxnett, its directors, employees, and affiliates from any claims, damages, liabilities, and legal expenses (including attorney's fees) resulting from your misuse of our services, violation of these Terms, or infringement of any third-party rights.
12. Changes to Terms
We may update these Terms of Service periodically to reflect operational, legal, or regulatory changes. If the modifications are material, we will notify you via the email address registered to your account or through a prominent notice on our website. Continued use of Foxnett services after the effective date of updated Terms constitutes your formal acceptance of the changes.
13. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Nepal, without regard to its conflict of law provisions.
Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Kathmandu, Nepal.
